Terms of service.
This Terms of Service Agreement (the "Agreement") is entered into between the service provider ("Yoo-Jin Kang") and the client ("Client") in connection with the provision of career coaching, organizational consulting, and trauma-informed healing sessions (collectively referred to as "Services"). By engaging in the Services, the Client agrees to the following terms and conditions:
Nature of Services: The Provider will deliver the Services as described in the agreed-upon scope of work or service agreement. The Services are intended to provide guidance, support, and resources to the Client for their personal and professional development, career advancement, organizational improvement, and trauma healing. The Provider is not responsible for guaranteeing specific outcomes or results.
Confidentiality: The Provider acknowledges and agrees to maintain strict confidentiality regarding any information shared by the Client during the course of the Services, unless required by law or as otherwise agreed upon in writing by the parties.
Client Responsibilities: The Client agrees to actively participate in the Services, provide accurate and truthful information, and engage in the recommended actions, exercises, or assignments as discussed and agreed upon with the Provider. The Client acknowledges that results may vary based on their level of commitment and effort.
Professional Boundaries: The Provider will maintain professional boundaries throughout the Services. The relationship between the Provider and the Client is strictly professional and does not constitute a therapeutic relationship or legal advice.
Fees and Payment: The Client agrees to pay the fees as outlined in the agreed-upon service agreement or fee schedule. Payment terms, including due dates and accepted payment methods, will be clearly communicated to the Client. Failure to make timely payments may result in the suspension or termination of Services and a $100 additional late fee.
Intellectual Property: Any materials, resources, or intellectual property provided by the Provider during the course of the Services are for the exclusive use of the Client. The Client agrees not to reproduce, distribute, or use such materials for any commercial purposes without the express written consent of the Provider.
Limitation of Liability: The Provider shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the Services or the Client's use of the information or resources provided. The Client assumes full responsibility for their decisions, actions, and outcomes resulting from the Services.
Termination: Either party may terminate the Services by providing written notice to the other party. In the event of termination, the Client shall be responsible for payment of any outstanding fees for Services already rendered.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Provider operates.
Entire Agreement: This Agreement constitutes the entire understanding between the Provider and the Client regarding the Services and supersedes any prior discussions, representations, or agreements, whether oral or written.
By engaging in the Services, the Client acknowledges that they have read, understood, and agreed to be bound by the terms and conditions set forth in this Agreement.
